This Privacy Notice explains what information Magnuson Athletic Club (“Magnuson Athletic Club”, “we”, “our”, or “us”) collects about you when you visit www.macseattle.com (the “Website”), how we use this information, with whom we share it, and the choices you have in connection with this.  

1. INFORMATION WE COLLECT AND WHY

Through your use of our Website, we collect personal information, which is information that identifies you as an individual, relates to you as an identifiable individual or, that along with other information, could identify you (collectively, “Personal Information”). We collect the following types of Personal Information:

A. Information You Provide To Us

When you engage with certain aspects of our Website, we collect Personal Information from you. This includes when you:

Contact us by phone, email, or by filling out a MAC Info Request form. When you contact us or send us any feedback, comments, or suggestions, we collect from you any Personal Information you choose to include in such communication, as well as your phone number if you contact us by phone or your email address if you contact us by email.  If you choose to contact us through our MAC Info Request form, we collect from you your name, email address, and any other Personal Information you choose to include in the form. We use this information to respond to your questions, feedback, comments, suggestions, or inquiries.

Apply for Employment. To apply for employment with us, we collect from you: your first and last name, address, phone number, email address, how you heard about us, the position for which you are applying, your availability, any information as may appear on your resume (if you choose to upload it), whether you have previously worked for Arena Sports and if so the location and position, why you want to work for Arena Sports, and any other Personal Information you choose to include in response to application questions. We also collect from you the first and last name, phone number, and email address of three references you provide. If you provide us with personal information of a reference or any other individual as part of your application, it is your responsibility to obtain consent from that individual prior to providing the information to us.

You have the option to provide us with information about your professional experience, and permit us to contact current and former employers. This includes the company name, address, phone number, start and end date, position, and reason for leaving. This also includes any training certificates, professional licenses and similar information. We may collect from you your education information, such as your high school and/or college name, start and end date, degree or level completed, and relevant coursework.

We use this information to respond to your application for employment.

Login to your account, sign up for group classes, and make online payments.  In order to login to your account, you will need to provide your username and password. Through your account, we also collect from you your address, phone number, email address, fitness interests, payment methods, and information you choose to enter about family members. We use this information to provide you with access to your account through Empower M.E., update your information in your account, make payments on your account, sign up for workout time slots or appointments, sign up for MACFIT Group Training, manage family members in your membership plan, purchase training packages, and view additional information we make available through your account. We use Jonas Fitness to provide you with the member account and process payments. Recover your username.  In order to recover your username, you will need to provide your first and last name, phone number, and email address.

Reset your password.  In order to reset your password, you will need to provide your username. We use this information to send you an email so that you can reset your password.

Make a membership inquiry. When you make a membership inquiry online you will need to provide your first and last name, email address, phone number, type of membership, and any other Personal Information you choose to include in your inquiry.  We use this information to respond to your inquiry. If you become a member, we also use this information to inform you about any changes to our Website or facilities. To become a member, we also collect your mailing and billing address, emergency contact information, birthdate, credit card or ACH information, and the names and birthdates of anyone else you want to include in your membership. We use this information to create a member account for you, process your payments for your membership, and manage your membership.

Sign up for and use a free trial membership. To get a free 3-day trial pass, you will need to provide your first and last name, email address, phone number, zip code, and any other Personal Information you choose to include in your sign-up. In order to use a free trial membership, you will also need to provide photo identification and must be at least 18 years old or 13 with a parent.  We use this information to provide you with the free trial membership.

Interact with our Social Media.  If you interact with us on our Facebook, Instagram, or YouTube account, including when you attend a Virtual Workout, we may collect your username, name, email address, photo, and any other Personal Information you make or is accessible to us when you connect with us.  We collect this information to allow you to follow us, see our events, and interact with us, and to engage with you on Social Media.

Enroll in personal training.  When you fill out the enrollment form, we collect from you your first and last name, email address, phone number, and any other Personal Information you choose to include in the form. We use this information to process your enrollment forms.

Use our MiniMAC Child Care.  In order to bring your child to our MiniMAC Child Care, the parent or guardian must provide a picture of themselves to be stored in Magnuson’s computer for identification. We also collect from the parent or guardian the name and birthdate of your child. We use this information to check your child into the facility and provide appropriate levels of care depending on the number and ages of children checked in.

Visit our facilities.  When you visit our facilities, we collect from you your member number. If you are not a member, we also collect your name and phone number. We use this information to keep track of membership use and facility capacity. If you use the inBody 370 Body Composition Analyzer at our facility, we collect from you your name. We use this information to provide you with information about your body composition and provide you with suggested fitness programs to achieve your goals. When you use the inBody 370 Body Composition Analyzer, we associate your results with an ID number that you may use to review your results at a later date.

Host a basketball party at our facility.  If you wish to schedule a basketball party at our facility, our parent company, Arena Sports, collects from you your first and last name, address, phone number, email address, child’s birthdate, child’s first and last name, requested party date, types of activities, number of expected guests, and whether you are planning on ordering food. To schedule or register the above on our Website Arena Sports uses a service provider called Dash. You can review Dash’s privacy policy here. Arena Sports shares your Personal Information with us so that we can provide you with the requested facility space for your party.

Promotional emails or text messages.  If you sign up for promotional emails and/or text messages, we collect from you your name, email address, and phone number. If you sign up for one of our programs, we may also enroll you in promotional emails automatically and to this end will collect the same information. You may opt out of receiving these email communications from us by following the unsubscribe link or instructions provided in any email. You may opt out of receiving these text messages from us by emailing us at [email protected] and requesting to no longer receive these messages.

B. Information Collected Automatically

When you use our Website, we use cookies and other technologies to automatically collect certain information about you. Cookies are text files that your web browser places on your computer or mobile device when you visit a website. Cookies can be “persistent” or “session” cookies. Persistent cookies stay on your device for a set period of time or until you delete them, while session cookies expire when you close your web browser. The cookies and other technologies deployed on our Website collect the following information:

Usage Information. Such as the pages on our Website you access, the frequency of access, what you click on, and when you access the Website.

Location Information. Information about your location, which may be determined through your IP address or geolocation.

Device Information. Information about the device you are using, such as hardware model, operating system, browser, and your Website preferences.

Strictly Necessary Cookies. These cookies are required for making use of our Website. These cookies include security cookies to authenticate users, prevent fraudulent use of our Website, and protect user data from unauthorized parties. Our strictly necessary cookies allow our Website to function and allow you to use the features of our Website.

Analytics Cookies. We use Google Analytics to collect some information we listed above about your use of the Website. We use the information we get from Google Analytics to improve the Website and to help you improve your experience. In order to collect this information, Google Analytics may set cookies on your browser, or read cookies that are already there. Google Analytics may also receive information about you from applications you have downloaded that partner with Google. We do not combine the information collected through the use of Google Analytics with personally identifiable information. Google’s ability to use and share information collected by Google Analytics about your visits to our Website or to another application which partners with Google is restricted by the Google Analytics Terms of Use and the Google Privacy Policy. Advertising Cookies.  We utilize Google Doubleclick to serve ads that appear on Google products and on sites across the Internet. Google places cookies, web beacons, and other similar technologies to serve you ads based on past visits to our website. Each customer receives a different conversion cookie. The information collected by the cookie is used to generate conversion statistics and allows us to see the total number of individuals who clicked on our ads. Please review Google’s privacy policy here for additional information on how Google uses the information collected. You can control how Google uses your information through Google’s Ads Settings.

We also use Google Remarketing to display advertisements to you about our goods and services across the internet, including on other websites you visit based on the fact that you have visited our website. Google may also display other advertisements across the internet to you about third party services using the Google AdSense network, although this is beyond our control. We use Facebook Pixel to customize our advertising and to serve you ads on your social media based on your browsing behavior. This allows your behavior to be tracked after you have been redirected to our website by clicking on the Facebook ad. The Facebook Pixel stores a cookie on your computer to enable us to measure the effectiveness of Facebook ads for statistical and market research purposes. We do not have access to the personal information collected through the Facebook Pixel. However, the information collected via the Facebook Pixel, on our website as well as other websites on which Facebook Pixel is installed, is also stored and processed by Facebook. Facebook may link this information to your Facebook account and also use it for its own promotional purposes in accordance with Facebook’s Data Usage Policy. The Facebook Pixel also allows Facebook and its partners to show you advertisements on and outside of Facebook. You can opt-out of displaying Facebook ads by visiting your Facebook Ad Settings, and you can clear and control the information third parties share with Facebook in your Off-Facebook Activity page. 2. HOW WE USE YOUR INFORMATION

We use the Personal Information we collect about you to:

  • Respond to your questions, feedback, comments, suggestions, or inquiries.
  • Respond to your application for employment.
  • Provide you with a user account and process your payments for your account.
  • Interact with you on social media.
  • Provide you with the requested services, including class sign-ups, child care, and other services we make available to you.
  • Provide you or your child with a free trial membership.
  • Permit you to schedule a birthday party at our basketball court.
  • Communicate with you about our Website or to inform you of any changes to our Website.
  • Send you information on new products and/or services we feel may be of interest to you.
  • Engage in internet-based advertising.
  • Maintain and improve our Website and the services offered thereon.
  • Diagnose Website problems and engage in fraud identification and prevention.
  • Monitor user experience.
  • Defend our rights and those of others.
  • Efficiently maintain our business.
  • Comply with the law.

We also process and share information in an aggregated, de-identified manner, where the information is shared as part of a statistical report and does not contain personal information.

3. HOW WE SHARE YOUR INFORMATION

We share your Personal Information for the purposes set forth below.

Service Providers. We share Personal Information with our service providers, such as payment processors, email providers, advertising providers, and analytics providers. We limit the information shared with our service providers to what is necessary to fulfill the services. We use the following providers:

Member Account and Payment Provider.  We use Jonas Fitness to provide you with a member account and to process payments made through your member account. If you pay for any services through your member account, we will share some of your Personal Information with Jonas Fitness in order to process your payment and provide the requested services to you. For more information on how Jonas Fitness collects and uses your Personal Information, you can review their privacy policy here.

Analytics Providers.  We use Google Analytics to collect information on your use of the Website to improve our Website. You may view Google Analytics Terms of Use and the Google Privacy Policy here for information about how Google uses the information provided to Google Analytics and how you can control the information provided to Google. You can control the information provided to Google and opt out of certain ads provided by Google by using any of the methods set forth here or using the Google Analytics opt out browser add-on here.

Other Third Parties.  We utilize Google Doubleclick to serve ads that appear on Google products and on sites across the Internet.  To opt out of targeted advertising by Google, you can go to Google’s ad settings.  You may also install the DoubleClick opt-out add-on. Once installed, even if you clear all your cookies and restart your browser, it will prevent the DoubleClick cookie from being saved to your browser. We also utilize Google Remarketing to display advertisements to you about our goods and services across the internet, including on other websites you visit based on the fact that you have visited our website. Google may also display other advertisements across the internet to you about third party services using the Google AdSense network, although this is beyond our control. Google collects Personal Information from you through the Google Map cookies used to provide the Virtual Tour. Within Magnuson Athletic Club. We share Personal Information within our corporate family, such as with subsidiaries, joint ventures, or affiliates, in order to efficiently carry out our business and to the extent permitted by law.

Corporate Reorganization. In the event that we enter into, or intend to enter into, a transaction that alters the structure of our business, such as a reorganization, merger, acquisition, sale, joint venture, assignment, consolidation, transfer, change of control, or other disposition of all or any portion of our business, assets or stock, we would share personal information with third parties, including the buyer or target (and their agents and advisors) for the purpose of facilitating and completing the transaction. We would also share Personal Information with third parties if we undergo bankruptcy or liquidation, in the course of such proceedings.

To Prevent Harm. We will share Personal Information if we believe it is necessary to detect, investigate, prevent, or take action against illegal activities, fraud, or situations involving potential threats to the rights, property, or personal safety of any person.

Legal Purposes. We will share Personal Information where we are legally required to do so, such as in response to court orders, law enforcement or legal process, including for national security purposes; to establish, protect, or exercise our legal rights, as required to enforce our terms of service or other contracts; to defend against legal claims or demands; to comply with the requirements of any applicable law; or as necessary to detect, investigate, prevent, or take action against illegal activities, fraud, or situations involving potential threats to rights, property, or personal safety of any person.

With Your Consent. We may request your permission to share your Personal Information for a specific purpose. We will notify you and request consent before you provide the Personal Information or before the Personal Information you have already provided is shared for such purpose. 

4. CHOICES ABOUT YOUR INFORMATION

Update Account Information.  You can update your account information (including your address, phone number, email address, fitness interests, username, password, and payment methods) at any time by logging in to your user account.

Online Advertising.  To opt-out of interest based advertising generally or to learn more about the use of this information you can visit the Network Advertising Initiative or the Digital Advertising Alliance. You can also visit the privacy settings of your Android or iOS device and select “limit ad tracking” (Apple iOS) or “opt-out of interest-based ads” (Android).

Google Analytics.  You can control the information provided to Google and opt-out of certain by using one of the methods set forth here. You can also download the Google Analytics opt-out browser add-on for Google Analytics, which can be found here.

Promotional Emails.  You may opt-out of receiving marketing emails from us by clicking the “unsubscribe” link provided with each email. If you unsubscribe from promotional emails, we will continue to send you notifications necessary to the Website, the services, and your purchases.

Promotional Text Messages.  With your consent, we may send you promotional text messages. You can opt out of these text messages at any time by emailing us at [email protected] and requesting to no longer receive these messages.

Cookies.  All session cookies expire after you close your browser. Persistent cookies can be removed by following your browser’s directions. 6. INFORMATION SECURITY

We implement and maintain commercially reasonable security measures to protect the Personal Information we collect. Our security measures include but are not limited to TLS 1.2 and Google reCAPTCHA. However, no security measure or modality of data transmission over the Internet is 100% secure and we are unable to guarantee the absolute security of the Personal Information we have collected from you transferred over the Internet.  

7. THIRD PARTY LINKS

Our Website may contain links to other sites that are not operated by us. This Privacy Notice applies solely to the Personal Information collected on our Website. If you click on a third-party link, you will be directed to that third-party’s website. We strongly advise you to review the privacy notice of every website you visit.

8. CHANGES TO THIS PRIVACY NOTICE

This Privacy Notice is subject to change. Changes to the Privacy Notice will be posted on this page and will indicate the date the changes go into effect. Please check back and review the Privacy Notice for any changes.
